The Committee was created at the request of the Xenia Township Zoning Commission and was comosed of Bruce Cornett, representing X-TAG, Ken Moore, Representing the people in the area, Dennis Phillips, representing Phillips Sand and Gravel, and Stacey Coburn, Represeting Cemex. A representative of the Zoning Commission attended the meetings.
The resolutions have been updated by this stakeholder Committee and approved by the Zoning Commission, Greene County Regional Planning and the Township trustees as of May 14th, 2003.
What do these changes mean to the residents of Xenia Township?
1. Companies wishing to extract minerals from land in Xenia Township must apply for a change in Zoning if their land isn't already zoned for mining. This requires a public hearding. The Zoning inspector will post a sign on the land in question to notify the public.
2. If the public doesn't agree with the determinations of the elected bodies they have the right to file a petition for referendum on the zoning change in the next general election.
3. A petition for referendum must be filed within 30 days after passage of the ruling that is being contested. 10% of the number of those who voted for Govenor in the last election.
4. Before a mining permit is issued a qualified professional registered engineer of the State of Ohio will complete a hydrological study of the areas surface and ground water to certify that no private or pubic water supply will be adversely affected due to lowering of the water table or contamination by the operation.
5. A progressive plan for concurrent mining and reclamation which restores the land to its original or agreed upon use will be in place.
6. A noise ordinance has been added.
7. A performance Bond and Closure Bond required.
8. The environmental impact of blasting, dust and debris left on public roads was addressed.
9. An annual Operating Permit is required for mineral extraction which certifies conformance to all requirements of Section 411 of the Resolutions.
10. The Xenia Township Zoning Inspector or designated substitute shall be granted access to the permitted land for on-site inspection after 24 hour notice has been given the operator, and the permit may be suspended or revoked if the operator is not in compliance.
We urge residents of Xenia Township to obtain a copy of the newly approved Mineral Extraction Resolutions from teh Township Office on SR 68 in Old Town.
The Sub Committe of X-TAG will continue to monitor the activities of Cemex and report to the community as information becomes available.
